Business Zoning

Zoning District Use - Central Business District (B1)

Uses Permitted
Any retail business or retail service
Places of amusement and assembly, offices, hotels, motels, used car lots, garages, and other motor vehicle services
Any manufacturing or processing establishment that does not create dust, smoke, noise, or odor outside the lot on which it is located and employing not more than ten persons, including the owner or operator.
Dwelling units occupying the same building as the principal business

Uses Prohibited
Uses which, in the opinion of the Board of Zoning Adjustment, would be detrimental to the development of the B1 Central Business District as the retail shopping area shall be prohibited including specifically, but not limited to:
a. Any manufacturing or processing establishment that creates excessive dust, smoke, noise, or offensive odor outside the lot on which it is located and which employs more than ten persons, including the owner or operator; or
b. Any on-site activity for the exploration or development of oil, natural gas, coal, or other minerals such as drilling, storage, mining (surface, auger, pit, underground, or in-situ), blasting, loading, or transporting of oil, gas, coal, or other mineral except over or through roads forming a part of the official state coal road system approved by the Kentucky Transportation Cabinet pursuant to KRS 42.455(7) or pipelines used for interstate transmission of gas if such pipelines are lawfully pre-existing as of the effective date of Ordinance 88-6 or located in the future within federal, state, or city rights-of-way.

Conditional Uses
Public Facilities such as libraries, parks, recreational facilities, hospitals, institutions, public communications media, and the like.
Planned-Development projects.

 

Zoning District Use - General Business District (B2)

Uses Permitted
Antique Shop
Automobile Service Station
Automobile Sales (new & used) and truck, mobile home, and boat sales and service
Automobile Parking Lot
Banks and other Financial Institutions, including Loan and Finance Companies
Curio or Gift Shop
Garages for repair of motor vehicles within a closed building
Gasoline Service Stations, including normally related services, but not including automobile repair
Grocery Store or Supermarket
Motels, Hotels, Tourist Cabins, and Tourist Courts
Restaurants, Grills, Cafes, and similar eating establishments
Self-Service Laundries
All signs permitted in B1 Central Business District
Retail Centers such as Shopping Malls or Shopping Centers
Office Buildings
Public Facilities such as auxiliary police or fire stations, main or branch post offices, or city or state highway garages.

Uses Prohibited
Any use not listed in Uses Permitted, above, of this section is prohibited in the B2 General Business District

Special Regulations
There shall be no outdoor storage or display of merchandise, and no processing or outdoor services shall be rendered unless authorized as a conditional use. All structures accessory to an outdoor conditional use shall be located at least 35 feet from front lot lines

Apparel Shops
Appliance Sales and Services
Bakery Shops employing not more than five persons on the premises
Banks and other financial institutions, including loan and finance companies.

Beauty Shops
Candy, Nut, and Confectionary Stores
Drugstores
Gasoline Service Stations, not including automobile repair
Grocery Stores
Hardware Stores
Health Clinics
Hobby Shops
Insurance Offices
Jewelry Stores
Professional Offices such as medical, dental, and real estate
Radio and television sales, service, and repair shops
Restaurants, grills, cafes, and similar eating establishments
Shoe Stores
Studios for professional work or teaching of any form of fine arts, photography, music, drama, or dance
Theaters
Variety Stores
Accessory uses permitted in this district are customary uses incidental to a use permitted above.

Renting of no more than three sleeping rooms in any one building
Permitted home occupations may be identified on the premises according to section 157.063 (A) (5). No displays or changes in the facade shall indicate from the exterior that the building is being utilized partly for a non-residential purpose.

Conditional Uses
Non-Profit public or Non-Profit private facilities such as schools, churches, cemeteries, libraries, parks, recreational facilities, hospitals, institutions, and the like.

B.J. EwenBuilding Inspector

B.J. Ewen, Building Inspector / Forum Manager (Hal Roger's Center)

BJ Ewen has a long history with the City of Hazard. An engineer with H.A. Spaulding, INC., the long-time city engineering and architecture firm, Ewen designed and oversaw the construction of many locally prominent buildings, including: the new City Hall, the new Hazard High School, Perry County Public Library, A.B. Combs Elementary, R.W. Combs Elementary, and Willard Elementary. He became the city Building Inspector in 1996.

Ewen is a 1954 graduate of Hazard High School and a graduate of the University of Kentucky. He lives in the Backwoods section of Hazard and is a member of Mother of Good Cousel Catholic Church. Ewen has three daughters, (Kathrine Harper, Mary Kidd, and Cynthia Clark), and five grandchildren.

Building Inspection

The City of Hazard's Office of Building Inspection monitors and enforces city, state, and federal building guidelines and regulations, as well as guidelines for building in and around the flood plain and floodway. Any new construction within city limits must have a building permit. The Office of Building Inspection strictly enforces the City of Hazard's Zoning District Use Regulations, Business and Residential, and all other applicable rules, regulations, and ordinances. Anyone considering the construction of a building within city limits is encouraged to consult with the Building Inspector during the initial planning stages of the project.

NOTE: Building permits are required for any construction or remodling on existing buildings when changes are planned / made to the size and / or structure of the building. (Roof work / repair is considered non-structural.)

A building permit is issued by the Building Inspector when the following have been submitted and reviewed and all codes and regulations have been met:

  • One (1) set of Building Plans
  • One (1) set of Plot Plans
